Donato & Garcia Neto Advogados (“DGN Advogados”), aware of the importance and of its duty in ensuring the privacy of personal data and documents provided by its external and internal users (hereinafter referred to as “Data Subjects”), and acting as the Controller of the processing of such personal data, hereby establishes this Privacy Policy.

APPLICABILITY

This Privacy Policy applies solely and exclusively to clients and personal data subjects of DGN Advogados.

APPLICABLE LEGISLATION

This Policy is governed by current Brazilian legislation, especially Law No. 13,709/18 (General Data Protection Law – LGPD) and Law No. 12,965/14 (Internet Civil Framework).

DEFINITIONS

  • Data Subject: the individual (clients, employees, partners, vendors, and service providers) to whom the personal data refers.

  • Processing: any operation involving personal data, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, storage, deletion, evaluation, modification, communication, transfer, dissemination, or extraction.
  • Controller: the individual or legal entity responsible for decisions regarding personal data processing.
  • Processor: the individual or legal entity that processes personal data on behalf of the Controller.
  • DPO (Data Protection Officer): the person appointed to serve as a communication channel between the Controller, the Data Subjects, and the National Data Protection Authority (ANPD).
  • User: individuals who access or interact with the services offered on websites or portals owned or controlled by DGN Advogados or its affiliates.

PURPOSE OF THIS POLICY

This Privacy Policy aims to inform Data Subjects about how DGN Advogados collects, processes, stores, and protects personal data, as well as clarify their rights and how they can be exercised.

PERSONAL DATA PROCESSING

DGN Advogados will only process personal data in accordance with the LGPD and in good faith. Personal data may be incorporated into DGN Advogados’ physical and digital databases, under its control as the Data Controller.

Data will be processed only for lawful and legitimate purposes, with the data subject’s consent or when legally required, including for the Controller’s legitimate interest when it does not override fundamental rights and freedoms.

Anonymized Data will not be considered Personal Data under this Policy, as they cannot identify a specific individual.

Personal data is processed for legal, regulatory, contractual, and legitimate purposes, as allowed under applicable law and to fulfill contractual obligations with the Data Subject.
