Digital Nomadism and Employment Relationships: When Is a Remote Worker Still Considered an Employee?

The rise of remote work and the growing trend of digital nomadism have reshaped the way companies and professionals structure their working relationships. With people working from different cities — or even different countries — a key question has emerged for both employers and workers: does an employment relationship still exist, even at a distance?

As with many issues in labor law, the answer depends on the specifics of each case. But certain legal criteria remain essential for determining whether an employment relationship exists, even in a remote environment.

The Core Elements That Define Employment Still Apply

Under Brazil’s Consolidation of Labor Laws (CLT), four requirements must be present to establish an employment relationship: personal work, regularity, compensation, and — above all — subordination.

Working outside the company’s physical premises — whether from a home office or another country — does not automatically eliminate these elements. Depending on how the company manages the relationship, a court may still recognize the existence of employment.

What About International Hiring?

Hiring digital nomads who work from outside Brazil calls for even greater attention. Even when the contract is issued by a foreign company, Brazilian labor law may still apply in certain situations — especially if the arrangement appears designed to disguise what is, in practice, a local employment relationship.

Companies adopting hybrid, remote, or international work models must carefully map out the legal risks involved. It is crucial to assess whether the chosen hiring structure, the level of autonomy granted, and the mechanisms of work oversight are aligned with the intended work model.
